Terms of Service

1. Acceptance of Terms

By accessing or using The Insider Index mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

The Service is operated by Jessey Charo, an individual based in Kenya ("we", "us", "our"). You can reach us at support@insiderindex.org.

We may modify these Terms. When we do, we change the date at the top of this page. For a change that affects what you may do in the Service, we will tell account holders in the app or by email before it takes effect. Your continued use of the Service after a change takes effect constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

The Service is for adults. Before your first forecast the app asks you to confirm your age. If you are under 18 you may not create an account or forecast.

3. Description of Service

From 1 November 2026, The Insider Index is a free forecasting service for information and learning. You read Yes or No questions about public future events, give the chance that the answer is Yes as a whole number from 1 to 99 percent, see the crowd forecast, and receive a score when the question resolves.

The Service is free and nothing of value is involved. You pay nothing to take part, and there are no purchases in the Service. You put nothing at risk when you forecast. Forecasts and scores have no value: they cannot be bought, sold, transferred, exchanged or redeemed for anything, and no reward of any kind is given for any forecast, score or result.

3.1 Questions. We write every question. Each question states the public source that will decide it and the date on which it closes. Questions are about public events such as sport results, weather, official statistics and published dates. We do not publish questions about politics.

3.2 The crowd forecast. The crowd forecast is the median of the forecasts on a question. It is shown only once five people have forecast. Below that number the app shows how many people have forecast so far.

3.3 Resolution. A question resolves Yes or No according to its stated source. We may void a question if the source does not publish, if the event does not take place, if the question proves to be ambiguous, or if we learn that a participant could influence the outcome or knew it in advance. A voided question produces no score for anyone. If you think a question was resolved wrongly, write to support@insiderindex.org. Where we find an error, we will correct the resolution. Otherwise our decision is final.

3.4 Scores. When a question resolves, your forecast receives a Brier score, a standard measure of forecast accuracy in which lower is better. Scores are shown only to you. The Service has no ranking of users and no public profiles.

3.5 The earlier news pages. Until they are withdrawn, the website also shows pages from the earlier news product about United States congressional disclosures and institutional filings. Those pages are for information only. Section 8 applies to them.

The Service does NOT:

  • Provide advice of any kind
  • Offer anything of value for taking part
  • Promise that any forecast, crowd forecast or question source is accurate or complete

4. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account
  • Hold only one account. An account is for one person and may not be shared

You can delete your account at any time in the app: open Account, then Delete account. Deletion is immediate and cannot be undone. The Privacy Policy explains what is removed.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, crawl, or use automated means to access the Service without authorization
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Attempt to gain unauthorized access to any systems or networks
  • Interfere with or disrupt the Service or servers
  • Transmit any malware, viruses, or harmful code
  • Use the Service to develop a competing product
  • Redistribute, resell, or sublicense access to the Service
  • Use data from the Service to provide services to third parties
  • Misrepresent your identity or affiliation

5.1 Forecasting rules

  • Forecast only from information that is available to the public.
  • Do not forecast on a question if you can influence its outcome, or if you know something about its outcome that is not public. This includes, for example, a player or official in a fixture, or a person who works for the body that publishes the figure a question depends on.
  • Do not use more than one account, and do not forecast for anyone else.
  • Do not try to move a crowd forecast by coordinating forecasts with other people, by automated means, or in any other way that does not reflect your own honest view.

We may remove forecasts, void questions, and suspend or close accounts that break these rules.

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Jessey Charo, who operates The Insider Index, and is protected by copyright, trademark, and other intellectual property laws.

Our trademarks, trade names, logos, and service marks (collectively, "Marks") may not be used without our prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms.

7. Third-Party Content and Links

The Service may contain links to third-party websites or display content from third parties. We do not endorse, control, or assume responsibility for any third-party content or websites. Your interactions with third parties are solely between you and such third parties.

8. No Investment Advice

THE SERVICE DOES NOT PROVIDE INVESTMENT ADVICE.

All information provided through the Service is for informational purposes only and should not be construed as financial, investment, tax, or legal advice.

You should consult with qualified professionals before making any investment decisions. We are not registered as a broker, dealer, investment advisor, or in any similar capacity.

Past performance of any investment is not indicative of future results. Investing involves risk, including the possible loss of principal.

The same applies to forecasting. Questions, crowd forecasts and scores are for information and learning. They are not advice of any kind, and you should not rely on them to make any decision.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF DATA
  • UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that the Service will meet your requirements or that any errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INSIDER INDEX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or use
  • Any trading losses or investment losses
  • Any damages arising from reliance on information provided through the Service
  • Any damages arising from interruption or unavailability of the Service

The Service is free. To the extent the law allows, our total liability for any claims arising from your use of the Service shall not exceed 10,000 Kenya shillings. Nothing in these Terms limits any right you have as a consumer that the law does not allow to be limited.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Insider Index and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of Kenya. The courts of Kenya have jurisdiction over any dispute arising from these Terms or your use of the Service.

Nothing in these Terms takes away a right that the consumer law of the country where you live gives you and that cannot be waived by agreement.

Please write to support@insiderindex.org first. Most problems can be settled that way.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Apple

If you use the app on an Apple device, these Terms are between you and us, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide support for it. Apple is not a sponsor of the Service and is not involved in any manner in any question, forecast or score in it. Your use of the app must also follow the App Store's own terms.
